The fifth section is between the Tawaf and the two rak'ahs
It is prescribed for a person who is traveling in the house
to pray after two rak'ahs, and the majority of the fuqaha 'say the Sunnah, and
some of them are obligatory.
Imam Ibn al-Mundhir said: "They agreed that a person
who had prayed seven times and prayed two rak'ahs is correct."
The fuqaha 'differed concerning the ruling on loyalty
between tawaaf and rak'ahs, according to two sayings:
The first view is that the loyalist is a Sunnah. If the
Tawaf and his Rakta are separated in a long time, it is permissible, and this
is the view of the Hanafis, Shaafa'is and Hanbalis.
They quoted him as follows:
1 - (Umar ibn al-Khattab may Allah be pleased with him
toured the house after the morning prayer, when he spent his tawaaf, he did not
see the sun Talaat, so he rode up to Anakh fold and prayed two rak'ahs).
2 - from Umm Salamah may Allah be pleased by the husband of
the Prophet - peace be upon him - that the Messenger of Allah - peace be upon
him - said - he was in Mecca, and wanted to go out and was not Salamah walked
around the house and wanted to go out - said to her Messenger of Allah - peace
be upon him A ladder -:) If the morning prayers are held, I will do my homework
and the people pray, so I did so, and I did not come until I came out.
The second view is that it is required to have a du'aa
'between tawaaf and rak'ahs. If long time separated, he must have blood if the
tawaaf is obligatory, which is the view of the Maalikis
I did not find them evidence of this requirement, and they
may infer that the Prophet - peace be upon him - and between the tawaaf and the
two rak'ahs, and he ordered to follow him said: Take your things .
It can be discussed: that the Prophet's companions - peace
be upon him - between tawaaf and two rak'ahs is not obligatory, but as a matter
of necessity, by the evidence of the first.
Weighting:
Al-Rajih - and God knows best - is the first saying that the
loyalty between tawaaf and rak'ahs is Sunnah, because it is possible to work
with all the evidence.
The sixth topic is between the Tawaf and the pursuit
The fuqaha 'differed concerning the ruling on loyalty
between tawaaf and seeking two sayings:
The first view is that the loyalty between them is a year,
so the chapter is not harmful for a long time. This is the view of the Hanafis,
and the saying of the Maalikis, the doctrine of the Shaafa'is, and the
Hanbalis.
They quoted him as follows:
1 - That each of the tawaaf and the corner, and the loyalty
between the pillars of Hajj does not require, such as standing at Arafah and
tawaaf al-ifaadah
2 - If the loyalty is not required to seek the same, between
him and the first tawaaf.
The second view is that loyalty between tawaf and saa'i is a
condition. If a difference is made between them, it is necessary to repeat
tawaaf and saa'i. This is a view of the Maalikis.
And quoted him: that the pursuit of the lack of progress
Tawaaf to distinguish him from God Almighty, lacked the loyalty between him and
him to fall by the concession, and does not get the advantage if it violates
the money
It can be discussed: that the privilege of seeking for other
than Allaah takes place with intention
Weighting:
Al-Rajih - and God knows best - is the first saying that
loyalty between the Tawaf and the Sunnah is for the strength of the evidence,
and because the requirement of loyalty is critical and difficult.
The seventh topic is the loyal between the pursuits
The fuqaha 'differed concerning the ruling on loyalty
between the two stages of the pursuit.
The first view is that the one who is loyal to the pursuit
of the Sunnah is the view of the Hanafis, the doctrine of the Shaafa'is, and a
narration in the Hanbalis that Ibn Qudaamah said: It is correct.
They quoted him as follows:
1 - That Souda bint Abdullah bin Omar sought, and spent her
tawaaf in three days
2 - That the pursuit of Nisk is not related to the house,
did not require him loyal, compared to throwing and barber.
This is the view of the Maalikis. It was narrated by the
Shaafa'is, and a narration by the Hanbalis. Most of them said that al-Mardawi
said: "This is the doctrine, and it is the most important of the
companions.”.
And they quoted him as saying: As for the proverb between
the tawaaf, it is a condition that has been discussed as a measurement with the
difference. It is not valid, because the tawaaf is related to the house, and
this is a prayer that requires purity and curtain.
Weighting:
Al-Rajih - and God knows best - is the first
saying that loyalty between the pursuit of a year; for the reasonableness of
what they quoted, and the weakness of the evidence of the second statement of
the discussion.
